Court Orders Provisional Seizure of 499 Eldense Shares Amid Pending Sale to Lionel Messi

The 499 shares are part of Eldense’s 3,147 registered shares owned by Carolina Olguín, which are currently in the process of being sold to Argentine footballer Lionel Messi. The court accepted a lawsuit filed by former club owner Pascual Pérez, who is demanding that Olguín repay a debt of €998,000 stemming from a loan issued in December.

The court issued its ruling on Monday, partially approving the plaintiff’s request for provisional measures. Pérez had previously requested the seizure of all club shares, arguing that the sale of the club could make it more difficult to recover the outstanding debt.

However, the court ruled that freezing all shares would be disproportionate compared with the amount being claimed. Therefore, the seizure was limited to 499 shares, with their value considered to be in line with the €998,000 claim. The court also took into account that Eldense was sold for €6.294 million in October 2025.

The court decided to impose the measure without first hearing Carolina Olguín’s arguments. The ruling stated that this was due to difficulties locating Olguín at the address provided in San Sebastián de los Reyes, Madrid.

The court also rejected another request from Pérez’s legal representatives to seize any potential claims Olguín might receive from a future transfer of shares. The ruling noted that there is currently no confirmation that the shares have already been transferred, and the application did not identify any potential buyer.

However, the decision leaves open the possibility for the plaintiff to request the seizure of other assets belonging to the defendant in the future, provided that information about those assets becomes available.

The ruling states that the decision cannot be appealed, but Carolina Olguín has the right to challenge the provisional measure within 20 days of receiving official notification.
